Announcement on the Competition for the Lease of Premises for a Cafeteria

The announcement regarding the competition for the lease of premises for a cafeteria (hereinafter referred to as the Announcement) has been developed in accordance with the Rules for the Lease of Non-Residential Premises of the Non-Profit Joint Stock Company "North Kazakhstan University named after M. Kozybayev", approved by the decision of the Board of NAO "North Kazakhstan University named after M. Kozybayev" dated March 29, 2021 (hereinafter referred to as the Rules), and the decision of the Board of SKU named after M. Kozybayev No. 13 dated August 28, 2023, due to the need to organize and provide catering services for students and staff of NAO "North Kazakhstan University named after M. Kozybayev" (the necessity of having a food service point).

Competition Title: "Lease of Premises for a Cafeteria"

Name and Location of the Competition Organizer:

NAO "North Kazakhstan University named after M. Kozybayev," Petropavlovsk, Pushkin St. 86 (hereinafter referred to as the Competition Organizer).

1. Date, Time, and Venue of the Competition

The meeting of the Competition Commission for opening envelopes with applications from potential tenants will be held at 10:00 AM local time on December 17, 2024, at the following address: Petropavlovsk, Pushkin St. 86, Building 1.

2. Submission Location and Deadline for Applications

Applications must be submitted by potential tenants (lessees) or their authorized representatives (acting based on a power of attorney) in a sealed envelope no later than 10:00 AM local time on December 17, 2024, at the following address: Petropavlovsk, Pushkin St. 86, Building 1.

Applications submitted after the deadline will not be accepted.

3. Brief Description and Information About the Leased Premises

The tenant is required, before receiving the non-residential premises under the Acceptance and Handover Act, to pay a Deposit (guaranteed monetary contribution) equivalent to three months’ rent into the Lessor's account within five working days from the signing of the Lease Agreement.

Lot No. 1: Non-residential premises for a cafeteria, 20.7 sq.m. (excluding the dining area), Petropavlovsk, Bostandykskaya St. 6, Dormitory No. 1, 1st floor.Lease Term: December 18, 2024 – June 18, 2025.

Minimum Monthly Rent: 45,147 KZT (including VAT) + utility costs (electricity, heating, water).

4. Competition Conditions and Selection Criteria

4.1.The Commission opens envelopes containing applications from potential tenants, compares the applications submitted within the established deadline, and records them in the official log on the final day of submission.

4.2. The winner of the competition is determined by the Commission by voting in the evaluation sheets according to the 5-point rating scale system according to the selection criteria specified in the announcement. The potential tenant with the highest score is considered the winner. The basis for the Commission's decision is the application of a potential tenant with the most favorable rental conditions for the Landlord, meeting or exceeding the requirements specified in the announcement.

Selection criteria:

1. Pricing of services.
2. Experience in catering.
3. Proposed rental price.
4. Presence of a catering network in the city.
5. Employment opportunities for students.
6. Additional services offered.

4.3.If there is a tie, the Chairperson of the Commission (or an authorized substitute) makes the final decision. If any Commission member disagrees, they may submit a written dissenting opinion, which will be attached to the meeting protocol.

4.4. If the winner refuses to sign the Lease Agreement, the Lessor has the right to sign the contract with the second-place applicant.

4.5.If only one application is received or if no applications are submitted, the competition is declared void. In such a case, the Commission Secretary prepares a protocol confirming the competition's failure.

5. Deadline for Application Submission

Applications must be submitted to the Competition Organizer by 10:00 AM local time on December 17, 2024, at Petropavlovsk, Pushkin St. 86, Building 1.

6. Standard Lease Agreement

The draft standard lease agreement is attached as Appendix 2 to the Announcement.

7. Technical Specifications and Other Lease Conditions

Details are provided in the Technical Specification (Appendix 1 to the Announcement).

8. Required Documents for Participation

8.1.On the front side of the sealed envelope with the application for participation in the competition, the potential Employer (tenant) must indicate:

1. full name and mailing address of the potential Employer (tenant);

2. the full name and postal address of the Contest Organizer, which must correspond to the similar information provided in this announcement.;

3. the full name of the competition, for which the application of a potential Employer (tenant) is submitted.

8.2. The application for participation in the competition is a form of consent for the participation of a potential Employer (tenant) in the competition for the lease of a dining room in accordance with the requirements and conditions set by the announcement.

8.3. The application for participation in the competition must contain:

1.contact information, including: name, legal address (for legal entities), ID number (passport), surname, first name, patronymic, place of residence (for individuals), bank details of the potential Employer (tenant);

2.name, location, area of the facility proposed for lease;

3.Purpose of the lease;

4.Planned lease terms;

5. Confirmation that the potential Tenant is familiar with and agrees with the terms of the standard lease agreement and the Rules by providing the original letter on the letterhead.;

6. the proposed rent, which cannot be lower than the approved cost of renting non-residential premises and fees for the use of the facility;

7. types of related services that a potential Employer (tenant) will provide within the framework of the facility;

8. Technical specifications and other proposals, including proposed investments, a business project, work on separable and inseparable improvements to the facility, etc.;

9. Notarized copies of the following documents or information from the portal system are attached to the application. egov.kz :

for legal entities – certificate of registration (re-registration) of a legal entity, certificate information about all registration actions of a legal entity, the Charter, license/permit and/or other document confirming the right to carry out a particular activity in accordance with the requirements of the technical specification or in accordance with the legislation of the Republic of Kazakhstan;

for individuals, a certificate of state registration of an individual entrepreneur (if any), an identity document for an individual, and an address certificate.

In the case of maintaining the register of participants in a limited liability partnership, a notarized copy of the extract from the register of participants of the partnership is provided.;

8.4. The application for participation in the competition is submitted by the potential Tenant (tenant) in writing, signed by the first supervisor or an authorized person and sealed (if any) in a sealed envelope before the deadline for submitting applications specified in the announcement.

10. Additional Information
